For my upcoming book of interviews with writers (Don Finkel, Carl Phillips, Ntozake Shange, Tess Gallagher, and so on) I've had to request from the copyright holders permission to reprint samples of the authors' work. Here's how it goes in real life:
Don Finkel: Son holds the rights, and granted them free.
John N. Morris: Requires an epic nationwide search to locate the John J. Morris who is Morris's son and the copyright holder. Finally located by Washington University, Morris grants permission free.
Graywolf Press: Holder of Carl Phillips and Tess Gallagher rights. Asking to reprint one poem from each, I filed requests online. In five days comes the Carl Phillips permission, costing $30. In three weeks comes the Tess Gallagher permission, costing $150. Graywolf says this is the author's designated price. I wrote the author to ask her to give me a break, but secretly I think it's great that a woman has the nerve to charge $150 to repint one of her poems.
St. Martin's Press: It's hard to find a shorter Ntozake Shange poem that isn't part of a play, but I did, in Riding the Moon in Texas, and faxed St. Martin's Press for permission. They granted it for $50.
As a sidelight, while researching permission rights I discovered it costs $5000 to quote from the song "Hotel California," specifically the line, "You can check out any time you like, but you can never leave." It seems that's because "you" will never be able to pay the bill.

How I Changed My Luck Some More
So, last year I put some sample poems online at poemhunter.com, and recently a photographer, a stranger, found the poem called "Blue Chicory," and requested permission to reprint it on her blog, alongside her artistic photo of a blue chicory blossom. And I said yes of course yes.
Without the Net, Ms. Dyer would never have read the poem. Without poemhunter.com it wouldn't have been posted. With poemhunter.com the author was easily traceable so that permission could be requested and granted.
Put a few of your own favorite poems on poemhunter.com, preferably if they've already been published and rights have reverted to you. If unpublished, they count as published when you post them, so think twice. It's a good place to post poems YOU love that no editor seems to like. Yes, a lot of stuff on poemhunter.com is dross, but certainly not yours, and you open up a chance for good things to happen. Even a small good thing. Every little bit builds confidence.

Stealing Prose
Author-friend's nonfiction prose article was published by a good litmag about 15 years ago.
Long before that, pre-Internet, the mag, without authors' permissions, had agreed to allow its contents to be republished in a lit-crit series sold to libraries. This series was later sold to a database, which allegedly "licensed" the article for use on a website -- one that caters to lazy or dishonest students, providing downloadable research papers, articles, bibliographies, and so on. The author was stunned to find the article there, priced at $6.99.
Author contacts this Plagiarism-R-Us website. Meets with arrogance and refusal to remove
the work. Database which allegedly "licensed" the article ignores Author's phone call and letter. Author contacts website's apparent ISP, which says it isn't the site's ISP. Nevertheless, after months, article is finally removed.
Author learns that although the copyright reverted to the author after publication, unless it was then specifically registered with Library of Congress, the author's right to this individual article is essentially theoretical. And it's highly unlikely damages could be recovered, for example, in court.
Screenwriters have a union. Songwriters have a union. For freelance writers there’s a National Writer’s Union offering legal advice and grievance assistance to members ($120/year) -- but how many editors would cheerfully “Hire a Union Writer!”? The Author’s Guild offers members ($90/year) much the same support, plus health-insurance deals, but no self-published authors are allowed.
Now read this again and underline every snag, snafu, artificial difficulty, loophole, clusterf---, and cryin’ shame in this true story about our profession.
